Residential Building Construction Agreement

Parties and Scope

This agreement, made on October 24, 2025 in Coimbatore, is between M/s G V ENGINEERS (Contractor) and Mrs. Vaishnavi.G (Owner/Contractee). It pertains to the construction of a residential building. Both parties’ full addresses are included to ensure legal clarity.

The construction scope includes adherence to the latest ISI standards and Tamil Nadu standard specifications, alongside additional requirements stipulated by the project’s architect.

Execution and Work Specifications

  • Work must follow client-approved plans in Schedule 'A'. Any deviations require owner approval with payments handled at agreed rates.
  • Contractor commits to work per drawings, specifications, and cost schedules.
  • Owner may engage external specialists for special or architectural work outside the main contract.
  • Construction completion is scheduled within nine calendar months from start, with an extra twenty days for rainy season delays.

Materials, Utilities, and Payment

  • Water, electricity, and fuel for the site will be supplied by the Owner at a specified main point.
  • The Contractor cannot change brand or quality of building materials without approval.
  • Price escalation clauses are strict: materials prices for aggregates, sand, steel, cement, and bricks are locked, with only ±5% variation allowed.

Dispute Resolution, Arbitration, and Responsibilities

  • Disputes resolved by a three-member arbitration panel: one arbitrator per party, third mutually agreed.
  • Majority decision is final; arbitration is mandatory before legal action.
  • All litigation must be within Coimbatore jurisdiction.
  • Contractor must support Engineer-in-Charge, provide samples, arrange night work if needed, and ensure alignment, levels, and defect corrections.
  • All site drawings must remain on-site and returned after completion.

Additional Clauses and Best Practices

  • Owner may engage external agents for specialized works.
  • Payment schedule, defect liability/warranty, termination, and governing law must be explicitly mentioned.
  • Contingency plans and change order processes must be clearly defined.
